Well, if your vehicle is running, and you are behind the wheel, and that’s considered an operation. However, there is a provision in the law that says you have to be on the public street or highway, or what’s called a public vehicular area.
If you are in the driveway of your apartment complex, then that’s an area that would be generally open to or used by the public for vehicular travel which is the definition of a public vehicular area, and the answer is yes. You could be charged. That’s illegal to be operating while impaired there, so sitting behind the wheel with the motor running, it would be enough. If you are in your own driveway at a private residence, then, in any case, that’s not a public vehicular area. You shouldn’t be charged with DWI.
